Fencing Requirements
According to the Residential Swimming Pool Safety Act:
All inground and semi-inground pools must be surrounded by an enclosure that restricts access. This includes fences that:
Prevent the passage of a spherical object 10 cm in diameter.
Have a minimum height of 1.2 meters.
Do not have any fixture or opening that could allow climbing.
If the enclosure is a chain-link fence, the mesh size must not exceed 30 mm unless slats are used, which must not allow the passage of a spherical object more than 30 mm in diameter.
Gates must be self-closing and self-latching and placed high enough to prevent young children from reaching them.
Special Considerations for Aboveground and Portable Pools
Aboveground pools with a wall height of at least 1.2 meters and portable pools with a wall height of at least 1.4 meters do not require an additional enclosure if access is controlled by:
A ladder with a self-closing, self-latching gate.
A platform or patio with protective enclosure features as described above.
Potential Fines
Non-compliance with these regulations can result in fines ranging from $500 to $700 for a first offence and $700 to $1,000 for subsequent offences.
